How a Revocable Living Trust Works

Creating a revocable living trust involves several key steps:

1. Establishing the Trust

You, the grantor, create the trust and transfer ownership of your assets into it.

2. Managing the Trust

As the trustee, you retain full control over the assets in the trust during your lifetime. You can add or remove assets and amend the trust as needed.

3. Planning for Incapacity

If you become incapacitated, a successor trustee will manage the trust according to your instructions, ensuring your needs are met.

4. Executing the Trust

Upon your passing, the successor trustee distributes the assets to your beneficiaries according to the terms of the trust, bypassing probate and ensuring a smooth transition.

The Process of Setting Up a Revocable Living Trust

Setting up a revocable living trust with Teewinot Legacy Planning is a straightforward process:

1. Initial Consultation and Meeting

At the initial meeting, we will get a better understanding of your family, your assets, and your estate planning goals. We will then work with you to design a revocable living trust plan that addresses all of the above.

2. Signing Meeting and Subsequent Funding

Shortly after our initial meeting, we will conduct a signing meeting to execute your documents, including the revocable trust, powers of attorney, and wills. We will also begin this process of changing the title to your assets to the newly created trust. This may include executing letters of instruction for bank accounts, deeds for real property, and assignments for personal property and business interests.

3. Ongoing Administration

Goals and circumstances change. We will be involved for the lifecycle of your estate plan in case anything needs to be changed or if an incapacity warrants causing the provisions addressing this in the estate plan to become effective.

4. Final Administration

We are happy to advise your successor trustees on the final administration of your estate plan when the time comes. This may include gathering the assets of the trust, discharging debts, setting up sub-trusts, or assisting with final distributions to beneficiaries.
